Note on data transfer to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not secure in terms of data protection law. If these tools are active, your personal data can be transferred to these third countries and processed there. Communication via WhatsApp

For communication with our customers and other third parties, we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland.

Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. WhatsApp, however, receives access to metadata that arise in the course of the communication process (e.g. sender, recipient and time). We would also like to point out that WhatsApp says it shares personal data of its users with its US-based parent company Facebook. WhatsApp is used on the basis of our legitimate interest in the fastest and most effective communication possible with customers, interested parties and other business and contractual partners (Art. 6 para. 1 lit. f GDPR). The communication content exchanged between and on WhatsApp remains with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected.

Newsletter data

MailChimp is a service with which, among other things, the dispatch of newsletters can be organized and analysed. If you enter data for the purpose of subscribing to the newsletter (e.g. email address), it will be stored on MailChimp’s servers in the USA.

With the help of MailChimp we can analyse our newsletter campaigns. When you open an email sent with MailChimp, a file contained in the email (so-called web beacon) connects to MailChimp’s servers in the USA. In this way it can be determined whether a newsletter message has been opened and which links have been clicked. Technical information is also recorded (e.g. time of access, IP address, browser type and operating system). This information cannot be assigned to the respective newsletter recipient. They are used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better adapt future newsletters to the interests of the recipients.

If you do not want an analysis by MailChimp, you have to unsubscribe from the newsletter. We provide a link for this in every newsletter message.

YouTube

This website integrates videos from the YouTube website. The operator of the website is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

When you visit one of our websites where YouTube is integrated, a connection to the YouTube servers is established. The YouTube server is informed which of our pages you have visited.

8. Audio and video conferencing

Data processing

We use online conference tools for communication with our customers. The individual tools we use are listed below. If you communicate with us via video or audio conference via the Internet, your personal data will be recorded and processed by us and the provider of the respective conference tool.

The conference tools collect all data that you provide / use to use the tools (email address and / or your telephone number). The conference tools also process the duration of the conference, start and end (time) of participation in the conference, number of participants and other “context information” in connection with the communication process (metadata).

In addition, the tool provider processes all technical data that is required to process online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker as well as the type of connection.

If content is exchanged, uploaded or made available in any other way within the tool, it is also stored on the servers of the tool provider. Such content includes in particular cloud recordings, chat / instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information that is shared while using the service.

Please note that we do not have full influence on the data processing operations of the tools used. Our options are largely determined by the corporate policy of the respective provider. Purpose and legal basis

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b GDPR). 9. Own services

Handling of applicant data

We offer you the opportunity to apply for a job with us (e.g. by e-mail, post or via an online application form). In the following, we inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other legal provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

When you send us an application, we process your relevant personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this under German law is para. 26 of the Federal Data Protection Act (BDSG) (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation) and – if you have given your consent – Art. 6 para. 1 lit. a GDPR. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data you submitted will be stored in our data processing systems on the basis of para. 26 BDSG and Art. 6 para 1. lit. b GDPR for the purpose of implementing the employment relationship.

Storage period of the data

If we are unable to make you a job offer, if you reject a job offer or withdraw your application, we reserve the right to retain the data you have provided on the basis of our legitimate interests (Art. 6 para. 1 lit. f DSGVO) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. This storage serves in particular as evidence in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g. due to an impending or pending legal dispute), the data will only be deleted when the purpose for further storage no longer applies.

If you are logged into your social media account and visit our profile, the operator of the social media portal can assign this visit to your user account. However, under certain circumstances, your personal data may also be collected, even if you are not logged in or do not have an account with the respective social media portal. In this case, the data collection takes place, for example, via cookies that are stored on your end device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles, where your preferences and interests are stored. Legal basis

Our social media presence is intended to ensure the most comprehensive presence possible on the internet. This is a legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal grounds, which are to be stated by the operators of the social networks (e.g. consent in accordance with Art. 6 para. 1 lit. a GDPR).

Person responsible and assertion of rights

If you visit one of our social media sites (e.g. Facebook), both we and the operator of the social media platform are jointly responsible for the data processing operations triggered during this visit. In principle, you can assert your rights (information, correction, deletion, restriction of processing, data portability and complaint) both vis-à-vis us and vis-à-visthe operator of the respective social media portal (e.g. vis-à-vis Facebook).

Please note that despite the fact, that we share responsibility with the social media portal operators, we do not have full influence on the data processing procedures. Our options are largely determined by the corporate policy of the respective provider.

Storage period

The data directly collected by us via the social media presence will be deleted from our systems as soon as you request us to delete it, revoke your consent to store it or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory legal provisions – in particular retention periods – remain unaffected.
